Note: Georgia probate filing fees are set statewide by O.C.G.A. 15-9-60 (Georgia Council of Probate Court Judges Schedule of Costs and Fees). Effective January 1, 2025 (2024 SB 232), the base fee for an initial decedent's-estate proceeding is $175.00, plus a mandatory $15 Indigent Defense fee (O.C.G.A. 15-21A-6) on most petitions, exclusive of service of process, publication of citation, certified copies, and recording charges. These statewide statutory amounts apply in every county; a county may add small local add-ons, so verify the current local total and payment rules with the county probate court before filing. Toombs County Probate Court publishes a costs-and-fees page and says users should call 912-526-8696 to verify amounts. The page lists selected decedent-estate initial filing fees, including $130 for petitions for temporary letters of administration, letters of administration, common-form probate, solemn-form probate, no administration necessary, solemn form with administration with will annexed, and year's support, plus $50 for letters of administration with will annexed after prior probate, $70 for selected leave-to-sell petitions, and $50 for selected waiver/discharge/division petitions. Required Documents

  • Certified Death Certificate

    Order several certified copies from the Georgia Department of Public Health, State Office of Vital Records.

  • Original Will

    The original signed will must be filed with the petition when the decedent left a will.

  • Petition to Probate Will in Common Form(GPCSF 4)

    Probate without advance notice to heirs. Faster, but the will can be challenged for up to four years after probate.

  • Petition to Probate Will in Solemn Form(GPCSF 5)

    Probate with formal notice to all heirs. The resulting judgment is binding immediately, with no four-year window to object.

  • Petition for Letters of Administration(GPCSF 3)

    Filed for an intestate estate (no will) to appoint an administrator.

  • Petition for Order Declaring No Administration Necessary(GPCSF 9)

    For qualifying intestate estates where no personal representative has been appointed, debts are absent or otherwise handled, and the heirs agree on division. O.C.G.A. 53-2-40.

  • Petition for Year's Support(GPCSF 10)

    Lets a surviving spouse or minor children claim a support award of property from the estate.
