Note: Clay County Probate Court says a Clay County resident may file a Last Will and Testament for safe-keeping for a one-time fee of $15. Estate petition totals, copies, certified copies, service, publication, guardian ad litem, evaluator, attorney, inventory, annual return, payment methods, and cutoff rules require direct Probate Court verification before filing.

Required Documents

  • Certified Death Certificate

    Order several certified copies from the Georgia Department of Public Health, State Office of Vital Records.

  • Original Will

    The original signed will must be filed with the petition when the decedent left a will.

  • Petition to Probate Will in Common Form(GPCSF 4)

    Probate without advance notice to heirs. Faster, but the will can be challenged for up to four years after probate.

  • Petition to Probate Will in Solemn Form(GPCSF 5)

    Probate with formal notice to all heirs. The resulting judgment is binding immediately, with no four-year window to object.

  • Petition for Letters of Administration(GPCSF 3)

    Filed for an intestate estate (no will) to appoint an administrator.

  • Petition for Order Declaring No Administration Necessary(GPCSF 9)

    For qualifying intestate estates where no personal representative has been appointed, debts are absent or otherwise handled, and the heirs agree on division. O.C.G.A. 53-2-40.

  • Petition for Year's Support(GPCSF 10)

    Lets a surviving spouse or minor children claim a support award of property from the estate.
