Note: Arkansas sets circuit court filing fees statewide. Opening a probate estate (petition for probate of will and appointment of personal representative, or petition for appointment of administrator) carries a filing fee of $165 collected by the Circuit Clerk; the statutory base filing fee for initiating a circuit court action is $150 under Ark. Code Ann. 21-6-403(b)(1), with additional statutory court fees bringing the commonly collected total to $165. A small estate affidavit (collection of small estates by distributee, Ark. Code Ann. 28-41-101) costs $25 to file plus $5 per certified copy and is available when the estate value, excluding encumbrances, homestead, and statutory allowances, does not exceed $100,000.
