Fee Schedule Signals
Probate Filing Fees
| Filing Type | Fee |
|---|---|
Formal Administration Standard probate for larger estates | $165 |
Small Estate Affidavit For estates under threshold (no court filing needed) | $25 |
Note: Arkansas sets circuit court filing fees statewide. The base statutory fee for initiating a cause of action in circuit court is $150 (Ark. Code 21-6-403); with mandatory statewide court automation and administration surcharges, the standard cost to open (file the petition for) a formal probate estate is reported as $165 across Arkansas counties. The small estate affidavit (Affidavit for Collection of Small Estate by Distributee, Ark. Code 28-41-101) costs $25 to file, plus $5 per certified copy. In addition to filing fees, an Arkansas estate must pay for mandatory newspaper publication of notice to creditors (commonly about $100-$200). Verify the current local total with the County Clerk before relying on a figure.
